Terms & conditions
Terms
These terms apply to video production, editing, motion graphics and photography services provided by Matteo Fain, freelance videographer based in Zurich, Switzerland. Individual agreements in a quote or in writing take precedence over these terms.
1. Agreement
A project can be agreed in writing or verbally, on the basis of a quote, an hourly or daily rate, or a fixed project budget. A project is confirmed once the client accepts the quote or gives the go-ahead to start.
2. Delivery and revisions
I carry out every project with care and according to the client's briefing. Final files are delivered digitally. Revision rounds included in the quote are free of charge; further changes, or changes outside the agreed scope, are charged at the hourly rate after prior notice.
3. Cancellation and postponement
If a confirmed project is cancelled, the client covers the work already done and any costs already incurred (for example crew, equipment or travel). Shooting dates can be moved by agreement.
4. Rights of use
Copyright in the work remains with Matteo Fain. Once the invoice is paid, the client receives a non-exclusive right to use the final deliverables for private and commercial purposes, for the agreed channels. Raw footage and project files are not part of the delivery unless agreed otherwise.
5. Portfolio and references
Unless agreed otherwise, I may show finished work, stills and behind-the-scenes material in my portfolio and on social media, and mention the client by name or logo as a reference. Confidential projects are, of course, kept private on request.
6. Storage of files
After delivery, final files and footage are kept for a limited time as a courtesy, but no long-term archive is guaranteed. Clients should keep their own copy of the delivered files. Longer storage is possible on request.
7. Client responsibility
The client makes sure that the material, music, logos and instructions provided are lawful and do not infringe the rights of third parties, and that people appearing in the footage have agreed to be filmed.
8. Applicable law
These terms are governed by Swiss law. The place of jurisdiction is Zurich, Switzerland.
